Legal Provisions Involved: Section 34, Section 43(4) and Section 4 of the Arbitration and Conciliation Act, 1996
Judgement by: Bombay High Court
Judge/Bench: Justice Sandeep V. Marne
Facts
The dispute related to unpaid invoices for services provided between 1 April 2009 and 11 March 2011. An arbitral award dated 28 November 2022 directed Laguna Resort Pvt. Ltd. to pay the outstanding amount to Concept Hospitality Pvt. Ltd. Laguna challenged this award before the Bombay High Court under Section 34, mainly claiming that the demand was time-barred.
Key Legal Provisions
Section 34, Section 43(4) and Section 4 of the Arbitration and Conciliation Act, 1996
Issues Raised
Whether the claim for unpaid invoices was barred by limitation and whether time spent in earlier arbitration could be excluded?
Arguments of the Case
Laguna argued that the earlier arbitration involved a different agreement and party, so limitation could not be extended. Concept Hospitality argued that the dispute over invoices was the same and that the merged company was entitled to claim exclusion of time.
Judgement
The Bombay High Court dismissed the petition and upheld the arbitral award. It held that the claim was not barred by limitation and that the objection about lack of an arbitration agreement was raised too late and stood waived. No legal error was found in the award.
