J&K and Ladakh High Court: Women Accused Are a Separate Category for Bail; Courts Should Not Apply the Same Strict Rules as for Men
J&K and Ladakh HC

Legal provisions involved: Proviso to Section 437(1) of the Code of Criminal Procedure, 1973; Sections 447, 323, 325, 336, 307 and 302 of the IPC.

Judgement by: Jammu & Kashmir and Ladakh High Court

Judge/Bench: Justice Rahul Bharti

Facts

An FIR was lodged alleging that several people entered the complainant’s house and assaulted his family with sticks. The complainant’s father later died due to the injuries, after which Section 302 IPC was added. Fourteen persons were charge-sheeted, including three women. Their bail pleas were rejected by the Sessions Court only because the offence was serious.

Key legal provisions

Proviso to Section 437(1) of the Code of Criminal Procedure, 1973

Sections 447, 323, 325, 336, 307 and 302 of the IPC.

Issues raised

Whether the Trial Court ignored the legal protection given to women accused under Section 437(1) CrPC while rejecting bail?

Arguments of the case

The women accused argued that no specific role was attributed to them in causing the death and that the law requires courts to consider bail for women differently. The State opposed bail due to the seriousness of the murder charge.

Judgement

The High Court held that women accused are a separate category under the law and their bail pleas should not be decided using the same strict standards as for men. Since the allegations were general and the trial had already progressed, the Court granted bail with conditions.
