Legal provisions involved: Section 20-F The Railways Act, 1989, The Land Acquisition (Special Railway Projects) Rules, 2016
Judgement by: Supreme Court of India
Judge/Bench: Justice Sanjay Kumar and Justice K. Vinod Chandran
Facts
Land in Chhattisgarh was acquired for a railway project and about 550 landowners received compensation. An inquiry found that a small number of owners allegedly got more money than they should through collusion with officials. FIRs were filed and the High Court set aside awards not just for those involved, but for others too, including a landowner named Niraj Jain who was not accused of any wrongdoing.
Key legal provisions
Section 20-F The Railways Act, 1989
The Land Acquisition (Special Railway Projects) Rules, 2016
Issues raised
Whether fraud by some landowners can justify cancelling all compensation awards, including for those not involved in the alleged fraud.
Arguments of the case
The appellant argued he was not part of any fraud or inquiry and should not have his award cancelled. The respondents argued that because fraud was found in the process, the entire compensation scheme should be reconsidered.
Judgement
The Supreme Court held that misconduct by a few does not affect the lawful compensation of others who were not implicated. It restored the appellant’s compensation and directed it be paid with interest within three months.
