Sahil Sharma Alias Maxx vs. State Govt. of NCT of Delhi (2025)

Delhi High Court grants bail to NDPS accused, citing lack of independent witnesses and no videography during recovery.
Delhi HC

Legal provisions involved: NDPS Act, 1985 (Sections 20, 22, 25)

Judgement by: Delhi High Court

Bench/Judge: Justice Amit Mahajan

Facts

The applicant was arrested based on secret information while travelling in a car. The police claimed to have recovered MDMA, methamphetamine, charas, and ganja from the vehicle and additional MDMA from his flat. The defence argued that the field testing kit and FSL reports did not match and that no independent witnesses or recordings supported the alleged recovery.

Key legal provisions

NDPS Act, 1985 (Sections 20, 22, 25)

Issues raised

Whether the contradictions in the chemical reports, absence of independent witnesses, and lack of photography or videography weakened the prosecution’s case enough to grant bail.

Arguments of the case

The defence highlighted inconsistencies between the field test and FSL report and pointed out the complete absence of public witnesses and visual evidence. The prosecution insisted that the recovery was valid and that scientific limitations explained the mismatch in test reports.

Judgement

The Delhi High court held that the unexplained absence of independent witnesses and the lack of photographs or videos in a public setting raised doubts. It also found that the discrepancy in test reports gave the applicant an initial benefit at the bail stage. Financial transactions with a co-accused were not enough to show involvement. Bail was granted.
