Facts
A husband alleged that his wife died because of negligence by doctors after a surgical delivery in a nursing home. The High Court held that before starting criminal proceedings against doctors, an independent medical opinion is necessary. Since no medical evidence showed negligence, the court quashed the criminal case, stating that continuing the proceedings would be a misuse of the legal process.
